States crack down on cadmium in kids' jewelry

Attleboro Falls, Mass.--State legislators in Connecticut and Minnesota recently voted into law bills that regulate the amount of cadmium in children's jewelry, according to a report from the Manufacturing Jewelers and Suppliers of America (MJSA).

The latest moves now make for a total of nine states that have introduced legislation to regulate cadmium in children's jewelry since January 2010, when an Associated Press (AP) article revealed that high levels of the toxic metal had been found in children's costume jewelry imported from China.

The Connecticut law (CT PL 10-113), which becomes effective July 1, 2014, limits cadmium in any children's jewelry up to 75 parts per million as measured by a total weight test. The Minnesota law (MN Chap 347, Article 6, Sec. 27) limits cadmium to the same amount, but measures the metal using a migration test, a test that determines the total amount of cadmium that can leach out of a sample over a set time period. Compliance with the latter law will become effective for manufacturers and wholesalers as of Jan. 1, 2011, and for retailers as of March 1, 2011.

While Connecticut and Minnesota have been busy passing their cadmium laws, Washington state recently rescinded regulations implementing a recent law (WA Revised Code Chap. 70.240), which had limited the amount of lead, cadmium and phthalates in all children's products, including jewelry. According to the MJSA, the state decided not to challenge the state preemption clause in the Consumer Product Safety Improvement Act, a federal law passed in 2008 that set standards for lead in children's products.

In the wake of the January AP report, Wal-Mart and accessories retailer Claire's began pulling cadmium-suspect children's jewelry from their shelves. Just last month, Wal-Mart, the largest jewelry retailer in the United States in terms of sales volume, pulled a line of Miley Cyrus-brand necklaces and bracelets after tests conducted by the AP found that the jewelry contained high levels of cadmium.

Since the initial AP report, both houses of Congress have introduced federal legislation to regulate cadmium in children's jewelry, and the Consumer Product Safety Commission continues to investigate the best methods for protecting children from the effects of the metal.
